These Terms and Conditions (hereinafter \u201cT&amp;C\u201d) govern the contractual relationship between My Peru Destinations (hereinafter \u201cthe Company\u201d) and the client (hereinafter \u201cthe Client\u201d) for the provision of tourism services in Peru, Bolivia, and Ecuador.<\/p><p><strong>1.2 Acceptance of the Terms<\/strong><\/p><p>By making a reservation with My Peru Destinations, the Client expressly accepts these T&amp;C in full. The reservation confirmation constitutes a binding contract between both parties under Peruvian law.<\/p><p><strong>1.3 Scope of Application<\/strong><\/p><p>These T&amp;C apply exclusively to My Peru Destinations as a corporate entity. Each specialized agency within our corporation maintains its own independent operational policies.<\/p><p>\u00a0<\/p><ol start=\"2\"><li><h4><strong> RESERVATIONS AND CONFIRMATION<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>2.1 Reservation Process<\/strong><\/p><ul><li>Reservations may be made via email, telephone, website, or through our authorized representatives.<\/li><li>All reservations require completion of the client information form with accurate and truthful data.<\/li><li>The Company reserves the right to request additional documentation to verify the Client\u2019s identity.<\/li><\/ul><p><strong>2.2 Reservation Confirmation<\/strong><\/p><p>A reservation is only considered confirmed after:<\/p><ul><li>Receipt of the required initial deposit<\/li><li>Written confirmation issued by My Peru Destinations<\/li><li>Verified availability of all contracted services<\/li><\/ul><p>The Client will receive a reservation voucher detailing the services, dates, prices, and applicable conditions.<\/p><p><strong>2.3 Availability<\/strong><\/p><ul><li>Services are subject to availability at the time of confirmation.<\/li><li>The Company does not guarantee availability until the deposit is received and formal confirmation is issued.<\/li><li>If a service is unavailable, equivalent or superior alternatives will be offered, or the deposit will be fully refunded.<\/li><\/ul><p>\u00a0<\/p><ol start=\"3\"><li><h4><strong> PRICES AND PAYMENTS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>3.1 Currency and Prices<\/strong><\/p><ul><li>All prices are expressed in U.S. dollars (USD) unless otherwise indicated.<\/li><li>Prices include only the services specifically detailed in the confirmed itinerary.<\/li><li>Prices are subject to change until the reservation is confirmed through payment of the deposit.<\/li><\/ul><p><strong>3.2 Payment Structure<\/strong><\/p><p><strong>Initial Deposit:<\/strong><\/p><ul><li>30% of the total package value at the time of booking<\/li><li>Non-refundable in case of cancellation by the Client<\/li><\/ul><p><strong>Final Payment:<\/strong><\/p><ul><li>Remaining 70% due at least 60 days before the start date<\/li><li>For bookings made within 60 days of departure, full payment is required immediately<\/li><\/ul><p><strong>3.3 Accepted Payment Methods<\/strong><\/p><ul><li>International bank transfer<\/li><li>Credit cards (3.5% processing fee may apply)<\/li><li>PayPal (processing fee may apply)<\/li><li>Other methods upon prior coordination<\/li><\/ul><p><strong>3.4 Excluded Surcharges<\/strong><\/p><p>Unless expressly stated, the following are <strong>NOT<\/strong> included:<\/p><ul><li>International flights to\/from Peru<\/li><li>Personal expenses, tips, and gratuities<\/li><li>Alcoholic beverages not specified<\/li><li>Travel insurance (strongly recommended)<\/li><li>Services not mentioned in the itinerary<\/li><li>Local tourism taxes where applicable<\/li><\/ul><p>\u00a0<\/p><ol start=\"4\"><li><h4><strong> CANCELLATION AND REFUND POLICIES<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>4.1 Cancellation by the Client<\/strong><\/p><ul><li>More than 90 days before start: 30% retained (initial deposit)<\/li><li>Between 89 and 60 days: 50% of total value retained<\/li><li>Between 59 and 30 days: 75% retained<\/li><li>Less than 30 days: No refund (100% retained)<\/li><\/ul><p><strong>4.2 No-Show<\/strong><\/p><p>Failure to appear on the start date without prior cancellation results in total forfeiture of payment (100% retained) with no refund.<\/p><p><strong>4.3 Cancellation by My Peru Destinations<\/strong><\/p><p>If the Company must cancel due to operational reasons:<\/p><ul><li>100% refund of payments made, or<\/li><li>Rescheduling at no additional cost for alternative dates, or<\/li><li>An alternative package of equivalent or superior value<\/li><\/ul><p><strong>4.4 Itinerary Modifications by the Client<\/strong><\/p><ul><li>Modification requests are subject to availability and additional costs.<\/li><li>Requests made more than 60 days in advance: possible without administrative fee.<\/li><li>Requests within 60 days: 15% administrative fee.<\/li><li>Date changes may be considered cancellations and new bookings.<\/li><\/ul><p><strong>4.5 Force Majeure<\/strong><\/p><p>In cases of force majeure (natural disasters, pandemics, war, government restrictions, etc.):<\/p><ul><li>No cancellation penalties apply.<\/li><li>Rebooking or a voucher valid for 24 months will be offered.<\/li><li>Refunds will follow the terms recoverable from third-party providers.<\/li><li>The Company is not responsible for additional expenses incurred by the Client.<\/li><\/ul><p>\u00a0<\/p><ol start=\"5\"><li><h4><strong> RESPONSIBILITY FOR THIRD-PARTY SERVICES<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>5.1 Nature of the Company as Intermediary<\/strong><\/p><p>The Company acts as an intermediary when contracting third-party services, including but not limited to:<\/p><ul><li>Hotels (including Belmond Hotels and other luxury properties)<\/li><li>Train services (luxury trains)<\/li><li>River cruises (Amazon River Cruises)<\/li><li>Domestic air and land transportation<\/li><li>Restaurants and culinary services<\/li><li>Tour guides and activity operators<\/li><\/ul><p><strong>5.2 Limitation of Liability<\/strong><\/p><ul><li>The Company assumes no responsibility for acts, omissions, negligence, or breaches by third-party providers.<\/li><li>Each provider operates under its own terms and conditions.<\/li><li>The Company will facilitate claims but does not assume direct responsibility for services provided by third parties.<\/li><\/ul><p><strong>5.3 Quality Standards<\/strong><\/p><ul><li>The Company selects high-quality providers consistent with the luxury segment.<\/li><li>Regular inspections are conducted, but the Company does not directly control third-party operations.<\/li><li>The Client accepts that variations in standards may occur and are outside the Company\u2019s control.<\/li><\/ul><p><strong>5.4 Claims<\/strong><\/p><ul><li>Complaints about third-party services must be reported immediately to the guide or Company representative.<\/li><li>The Company will make its best efforts to resolve issues on site.<\/li><li>Post-trip claims must be submitted in writing within 30 days of trip completion.<\/li><\/ul><p>\u00a0<\/p><ol start=\"6\"><li><h4><strong> TRAVEL INSURANCE<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>6.1 Strong Recommendation<\/strong><\/p><p>My Peru Destinations strongly recommends full international travel insurance covering:<\/p><ul><li>Trip cancellation<\/li><li>Trip interruption<\/li><li>Medical and hospitalization expenses<\/li><li>Emergency medical evacuation<\/li><li>Baggage loss<\/li><li>Flight delays<\/li><\/ul><p><strong>6.2 Liability Exclusion<\/strong><\/p><ul><li>The Company is NOT responsible for medical expenses, evacuation, or repatriation.<\/li><li>The Client assumes full responsibility for traveling without insurance.<\/li><li>Lack of insurance does not exempt the Client from payment obligations.<\/li><\/ul><p><strong>6.3 Recommended Coverage<\/strong><\/p><p>Given the nature of our destinations (high altitude, remote areas, adventure activities), recommended minimum coverage includes:<\/p><ul><li>Medical expenses: USD $100,000<\/li><li>Medical evacuation: USD $250,000<\/li><li>Adventure-activity coverage according to the itinerary<\/li><\/ul><p>\u00a0<\/p><ol start=\"7\"><li><h4><strong> DOCUMENTATION REQUIREMENTS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>7.1 Passports<\/strong><\/p><ul><li>Passport valid for at least 6 months from return date<\/li><li>Sufficient blank pages for immigration stamps<\/li><li>Client is responsible for verifying passport validity<\/li><\/ul><p><strong>7.2 Visas and Permits<\/strong><\/p><ul><li>The Client is responsible for obtaining required visas for Peru, Bolivia, and Ecuador.<\/li><li>The Company may provide general information but does not guarantee accuracy.<\/li><li>Clients should consult the appropriate embassies or consulates.<\/li><\/ul><p><strong>7.3 Vaccination Certificates<\/strong><\/p><ul><li>Certain destinations may require vaccines (e.g., yellow fever for Amazon regions).<\/li><li>Clients must consult their country\u2019s health authorities.<\/li><li>Some providers may deny service without required certificates.<\/li><\/ul><p><strong>7.4 Special Permits<\/strong><\/p><ul><li>Certain archaeological sites require advance permits (e.g., Inca Trail, Huayna Picchu).<\/li><li>The Company manages these permits but requires accurate client information.<\/li><li>Errors in provided information may lead to denied access without refund.<\/li><\/ul><p>\u00a0<\/p><ol start=\"8\"><li><h4><strong> HEALTH CONDITIONS AND PHYSICAL FITNESS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>8.1 Health Declaration<\/strong><\/p><p>The Client must inform the Company of:<\/p><ul><li>Relevant pre-existing medical conditions<\/li><li>Medications regularly required<\/li><li>Food or other allergies<\/li><li>Physical or mobility limitations<\/li><li>Pregnancy<\/li><li>Any condition that may affect participation in activities<\/li><\/ul><p><strong>8.2 Altitude Sickness<\/strong><\/p><ul><li>Destinations like Cusco, Puno, and La Paz are at high altitude (3,300\u20133,800 m.a.s.l.).<\/li><li>Altitude sickness symptoms may be severe.<\/li><li>Clients should consult their doctor before traveling to high-altitude areas.<\/li><li>The Company is not responsible for complications related to altitude.<\/li><\/ul><p><strong>8.3 Physical Fitness for Activities<\/strong><\/p><ul><li>Some activities require moderate to advanced physical fitness.<\/li><li>Clients must honestly assess their abilities before booking.<\/li><li>The Company may deny participation for safety reasons.<\/li><li>No refund applies for activities not undertaken due to Client decision or safety considerations.<\/li><\/ul><p><strong>8.4 Medical Attention<\/strong><\/p><ul><li>Access to medical care may be limited in remote destinations.<\/li><li>The Client assumes the risks of traveling to hard-to-reach areas.<\/li><li>Medical care, evacuation, and repatriation costs are the Client\u2019s responsibility.<\/li><\/ul><p>\u00a0<\/p><ol start=\"9\"><li><h4><strong> ITINERARY MODIFICATIONS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>9.1 Modifications by the Company<\/strong><\/p><p>The Company may modify itineraries due to:<\/p><ul><li>Adverse weather conditions<\/li><li>Tourist site closures<\/li><li>Strikes or social unrest<\/li><li>Safety concerns<\/li><li>Force majeure<\/li><li>Operational decisions to improve experience<\/li><\/ul><p><strong>9.2 Equivalent Alternatives<\/strong><\/p><ul><li>The Company will offer alternatives of equivalent or superior value.<\/li><li>No partial refunds for necessary modifications.<\/li><li>The Company will make maximum efforts to maintain the itinerary\u2019s value and quality.<\/li><\/ul><p><strong>9.3 Site Closures<\/strong><\/p><p>Sites such as Machu Picchu or the Inca Trail may close without notice due to maintenance, weather, or government decisions.<\/p><ul><li>Alternatives will be offered when possible.<\/li><li>No refunds will be issued for closures beyond the Company\u2019s control.<\/li><li>Clients are advised to purchase insurance covering such contingencies.<\/li><\/ul><p><strong>9.4 Extensions and Additional Services<\/strong><\/p><ul><li>Clients may request extensions or additional services subject to availability.<\/li><li>Additional costs must be paid prior to service.<\/li><li>Extensions do not modify original package cancellation policies.<\/li><\/ul><p>\u00a0<\/p><ol start=\"10\"><li><h4><strong> BEHAVIOR AND CONDUCT<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>10.1 Code of Conduct<\/strong><\/p><p>The Client agrees to:<\/p><ul><li>Respect local laws of Peru, Bolivia, and Ecuador<\/li><li>Behave respectfully toward guides, staff, and other travelers<\/li><li>Respect archaeological sites and cultural heritage<\/li><li>Avoid participation in illegal activities<\/li><li>Follow safety instructions from guides and staff<\/li><\/ul><p><strong>10.2 Termination of Services<\/strong><\/p><p>The Company may terminate services with no refund if the Client:<\/p><ul><li>Endangers other travelers or staff<\/li><li>Behaves abusively, violently, or in a discriminatory manner<\/li><li>Participates in illegal activities<\/li><li>Is under the influence of substances affecting behavior<\/li><li>Damages third-party property<\/li><\/ul><p><strong>10.3 Legal Consequences<\/strong><\/p><p>The Client is responsible for any legal consequences of their actions, including fines, arrests, or deportations. The Company assumes no responsibility or associated costs.<\/p><p>\u00a0<\/p><ol start=\"11\"><li><h4><strong> LUGGAGE AND BELONGINGS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>11.1 Responsibility for Luggage<\/strong><\/p><ul><li>The Client is responsible for their luggage and personal belongings.<\/li><li>The Company is not responsible for loss, theft, or damage.<\/li><li>Travel insurance covering luggage loss is recommended.<\/li><\/ul><p><strong>11.2 Luggage Restrictions<\/strong><\/p><ul><li>Weight and size restrictions may apply to trains, domestic flights, and certain routes.<\/li><li>Clients must comply with restrictions provided in advance.<\/li><li>Excess baggage may not be transported or may incur additional fees.<\/li><\/ul><p><strong>11.3 Valuable Items<\/strong><\/p><ul><li>Traveling with high-value items is discouraged.<\/li><li>Use hotel safes when available.<\/li><li>The Company assumes no responsibility for lost or stolen valuables.<\/li><\/ul><p>\u00a0<\/p><ol start=\"12\"><li><h4><strong> COMPLAINTS AND DISPUTE RESOLUTION<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>12.1 Complaint Process<\/strong><\/p><p><strong>During the trip:<\/strong><\/p><ul><li>Report issues immediately to the guide or Company representative.<\/li><li>The Company will make maximum efforts to resolve issues on site.<\/li><li>Document issues with photos or evidence whenever possible.<\/li><\/ul><p><strong>After the trip:<\/strong><\/p><ul><li>Submit written complaints within 30 calendar days after the end of the trip.<\/li><li>Include supporting documentation (photos, receipts, testimonies).<\/li><li>Send to the Company\u2019s official complaints email address.<\/li><\/ul><p><strong>12.2 Response Time<\/strong><\/p><ul><li>The Company will respond to formal complaints within 15 business days.<\/li><li>Claims will be investigated impartially.<\/li><li>Reasonable solutions will be offered when appropriate.<\/li><\/ul><p><strong>12.3 Compensation Limitation<\/strong><\/p><ul><li>Compensation is limited to the cost of the affected services.<\/li><li>Indirect expenses, lost time, or moral damages will not be compensated.<\/li><li>Maximum compensation will not exceed the total amount paid for the package.<\/li><\/ul><p><strong>12.4 Mediation and Arbitration<\/strong><\/p><p>For unresolved disputes:<\/p><ul><li>Mediation will be attempted through a competent body in Peru.<\/li><li>Parties agree to submit to arbitration under Peruvian law.<\/li><li>Arbitration is final and binding for both parties.<\/li><\/ul><p>\u00a0<\/p><ol start=\"13\"><li><h4><strong> JURISDICTION AND APPLICABLE LAW<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>13.1 Applicable Law<\/strong><\/p><p>These T&amp;C are governed by the laws of the Republic of Peru, including:<\/p><ul><li>Consumer Protection and Defense Code (Law No. 29571)<\/li><li>General Tourism Law (Law No. 29408)<\/li><li>Applicable INDECOPI regulations<\/li><li>Regulations of the Ministry of Foreign Trade and Tourism (MINCETUR)<\/li><\/ul><p><strong>13.2 Jurisdiction<\/strong><\/p><p>Parties expressly submit to the jurisdiction of the courts of Lima, Peru, waiving any other jurisdiction that may correspond.<\/p><p><strong>13.3 Competent Authority<\/strong><\/p><p>For consumer protection matters, the competent authority is INDECOPI (National Institute for the Defense of Competition and Protection of Intellectual Property).<\/p><p>\u00a0<\/p><ol start=\"14\"><li><h4><strong> PERSONAL DATA PROTECTION<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>14.1 Data Collection<\/strong><\/p><p>My Peru Destinations collects and processes personal data necessary to provide tourism services, including:<\/p><ul><li>Identification data (name, passport, nationality)<\/li><li>Contact details (email, phone, address)<\/li><li>Payment information<\/li><li>Health information relevant to the trip<\/li><li>Dietary preferences and allergies<\/li><\/ul><p>\u00a0<\/p><p><strong>14.2 Data Use<\/strong><\/p><p>Data will be used exclusively for:<\/p><ul><li>Reservation management and service delivery<\/li><li>Trip-related communication<\/li><li>Compliance with legal obligations<\/li><li>Sharing with third-party providers necessary for services<\/li><li>Marketing (with the Client\u2019s prior consent)<\/li><\/ul><p>\u00a0<\/p><p><strong>14.3 Protection and Confidentiality<\/strong><\/p><ul><li>The Company implements security measures to protect personal data.<\/li><li>Data will not be sold or shared with unrelated third parties.<\/li><li>The Client has the right to access, rectify, and delete their data.<\/li><\/ul><p>\u00a0<\/p><p><strong>14.4 Consent<\/strong><\/p><p>By accepting these T&amp;C, the Client consents to the processing of their personal data as described.<\/p><p>\u00a0<\/p><ol start=\"15\"><li><h4><strong> PHOTOGRAPHS AND PROMOTIONAL MATERIAL<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>15.1 Use of Images<\/strong><\/p><p>During the trip, Company representatives may take photographs or videos for promotional purposes. By accepting these T&amp;C, the Client:<\/p><ul><li>Consents to the use of their image in promotional materials<\/li><li>Waives claims for the use of their image<\/li><li>May request exclusion with prior written communication<\/li><\/ul><p>\u00a0<\/p><p><strong>15.2 Social Media<\/strong><\/p><p>The Client authorizes tagging and use of photographs on social media unless an express exclusion request is submitted.<\/p><p>\u00a0<\/p><ol start=\"16\"><li><h4><strong> FINAL PROVISIONS<\/strong><\/h4><\/li><\/ol><p>\u00a0<\/p><p><strong>16.1 Severability<\/strong><\/p><p>If any provision of these T&amp;C is deemed invalid or unenforceable, the remaining provisions will remain in full force.<\/p><p><strong>16.2 Modifications<\/strong><\/p><p>The Company reserves the right to modify these T&amp;C at any time.
